Longshore & Harborworkers' Compensation Act
The Longshore and Harbor Workers' Compensation Act (LHWC), 33 U.S.C. §903,
covers areas the Jones Act leaves out; specifically, those employees who do not
qualify as a "seaman" because they spend less than 30 percent of their time in
service of a vessel in navigation. It also is used for land-based workers so
long as the disability or death results from an injury occurring upon the
navigable waters of the United States (including any adjoining pier, wharf, dry
dock, terminal, building way, marine railway, or other adjoining area
customarily used by an employer in loading, unloading, repairing, dismantling,
or building a vessel). So even though you may not qualify under the Jones Act,
